Terms and Conditions of Trade
1. General
1.1. These Terms and Conditions (“Agreement”) apply to all products and services sold by PINKLAND (“we”, “us”, “our”) to the customer (“you”, “your”) via our website www.pinkland.co.nz.
1.2. By accessing our website and placing an order, you agree to be bound by these terms.
1.3. We reserve the right to amend these terms at any time. The terms applicable to your order are those posted on the website at the time of your purchase.
2. Pricing and Payment
2.1. All prices displayed on the website are in New Zealand Dollars (NZD) and include Goods and Services Tax (GST) of 15%, unless stated otherwise.
2.2. Prices are subject to change without notice.
2.3. We accept payment via credit card and other electronic payment methods displayed at checkout. Your order will only be processed once payment has been cleared.
3. Orders and Acceptance
3.1. All orders are subject to acceptance by PINKLAND. We may reject an order due to stock unavailability, pricing errors, or suspicion of fraudulent activity.
3.2. If we cancel an order after you have paid, we will refund the full amount to your original payment method.
4. Delivery
4.1. We deliver within New Zealand. Delivery times are estimates only and we are not liable for delays caused by the courier service or force majeure events.
4.2. Risk of loss or damage to the goods passes to you upon delivery to the address provided in your order.
5. Consumer Guarantees Act 1993 (CGA)
5.1. Nothing in these terms is intended to limit your rights under the Consumer Guarantees Act 1993.
5.2. If you are acquiring goods for personal, domestic, or household use, you have certain rights if the goods are faulty, not fit for purpose, or do not match the description. In such cases, we will repair, replace, or refund the item in accordance with the Act.
5.3. If you are acquiring goods for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply.
6. Returns and Refunds Policy
6.1. Change of Mind: Unlike the CGA requirements, we voluntarily offer a “Change of Mind” return policy. You may return items within 7 days of receipt, provided that:
- The item is in its original, unopened condition with all packaging intact.
- The item has not been used or tested.
- You provide proof of purchase.
- Note: Shipping costs for “Change of Mind” returns are the responsibility of the customer.
6.2. Faulty Goods: If an item is damaged or defective upon arrival, please contact us immediately. We will arrange for a replacement or refund, including shipping costs, in accordance with the Consumer Guarantees Act.
6.3. Exceptions: For hygiene reasons, we cannot accept returns on opened cosmetics, skincare, or personal care products unless they are faulty.
7. Privacy Policy
7.1. We are committed to protecting your privacy in accordance with the Privacy Act 2020.
7.2. We collect personal information (name, address, email, phone number) solely for the purpose of processing your order and improving our services.
7.3. We do not sell or trade your personal information to third parties.
8. Intellectual Property
8.1. All content on this website, including text, graphics, logos, and images, is the property of PINKLAND and is protected by copyright laws. You may not use any content without our prior written permission.
9. Limitation of Liability
9.1. To the extent permitted by law, PINKLAND shall not be liable for any indirect, incidental, or consequential damages arising out of the use of our website or products.
10. Governing Law
10.1. These terms are governed by the laws of New Zealand. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
11. Reward Points
11.1. Reward Points may be awarded for purchases and can be used as a discount on future orders.
11.2. Points are not redeemable for cash and expire upon account termination or as otherwise specified in our rewards policy.
